1. Acceptance of Terms

Welcome to PennySim. By accessing or using our website at pennysim.com and our eSIM services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

PennySim is an eSIM marketplace that provides digital SIM card services for international travel. Our Service allows you to purchase, download, and activate eSIM data plans for use in over 190 countries worldwide. eSIMs are delivered digitally via QR codes sent to your registered email address.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

To purchase eSIM plans, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your account if any information changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5. eSIM Products and Purchases

5.1 Product Information

We strive to ensure all product descriptions, pricing, coverage areas, and data allowances are accurate. However, we do not warrant that product descriptions or pricing are error-free. If a product is listed at an incorrect price, we reserve the right to cancel orders placed at that price.

5.2 Pricing and Payment

All prices are displayed in US Dollars (USD) unless otherwise stated. Payment must be made in full at the time of purchase through our accepted payment methods. You agree that you are authorized to use the payment method provided and that the payment information is accurate.

5.3 Device Compatibility

eSIM functionality requires a compatible device. It is your responsibility to verify that your device supports eSIM technology before making a purchase. PennySim is not responsible for purchases made for incompatible devices.

5.4 Activation and Delivery

Upon successful payment, your eSIM QR code will be delivered to your registered email address. You are responsible for scanning and installing the eSIM on your compatible device. eSIM plans begin their validity period upon first activation on a supported network in the coverage area, unless otherwise specified.

6. Refund and Cancellation Policy

Due to the digital nature of eSIM products:

• Before activation: If you have not scanned or installed the eSIM QR code, you may request a full refund within 30 days of purchase by contacting our support team
• After activation: Once an eSIM has been activated (installed and connected to a network), it is considered used and is not eligible for a refund
• Technical issues: If you experience technical difficulties preventing you from using the eSIM after activation, please contact our support team. We will investigate and may offer a replacement, credit, or refund at our discretion
• Duplicate purchases: If you accidentally purchase the same plan twice, contact us promptly and we will issue a refund for the duplicate

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Engage in any activity that is fraudulent, deceptive, or misleading
• Resell, redistribute, or commercially exploit eSIM plans without our written consent
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Transmit malware, viruses, or any other malicious code

8. Data Usage and Fair Use

Each eSIM plan comes with a specified data allowance and validity period. Data usage is subject to the fair use policies of the underlying network operators. Excessive or abusive data usage patterns (such as tethering large volumes of data, running servers, or engaging in activities that degrade network performance for other users) may result in throttling or suspension of service at the discretion of the network operator.

9. Coverage and Service Quality

While we partner with premium network operators worldwide, we cannot guarantee uninterrupted service or specific connection speeds. Coverage, speed, and availability may vary based on location, network conditions, device capability, and other factors beyond our control. The coverage maps and speeds indicated on our website are estimates and should not be treated as guarantees.

10. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, images, and software, is the property of PennySim or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any of our content without our prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENNYSIM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless PennySim and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Any provisions of these Terms that by their nature should survive termination shall continue in full force and effect.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
